Court of Protection

The Court of Protection is a specialist court for all issues relating to people who lack capacity to make specific decisions. The Court makes decisions and appoints deputies to make decisions in the best interests of those who lack capacity to do so.

What does a Deputy do?

The Deputy order can apply to any area in which the person could have acted or made decisions for themselves if they had the capacity to do so.

The powers might relate to:

• finances;
• personal welfare, such as giving or withholding consent to medical treatment and/or social care interventions.

Powers given will depend on the needs of the person you have been appointed to assist and also the Court's decision.
